GOP Senators Call Out Biden Admin Justice Department After Antifa Police Attacker Case Is Dropped
Two Republican senators are speaking out after a Portland Antifa rioter who assaulted a police officer had the case dismissed after just 30 hours of community service.
On August 8, 2020, Eva Warner of Beaverton, Oregon, also known as Joshua Warner, was arrested for “Unlawful Directing of Light From a Laser Pointer, Interfering with a Peace Officer, Disorderly Conduct in the Second Degree,” according to the Portland Police Bureau.
Eight other arrests were made in relation to the Antifa riot and were booked in the Multnomah County Detention Center. Warner was later released without bail. Warner was arrested two other times shortly afterward and was also released without bail, according to Fox News. The charges could have included up to a five-year maximum sentence.
On September 3, 2020, the Department of Justice (DOJ) filed a press release regarding a charge of civil disorder filed against Warner that read in part:
Oregon State Police officers notified the Portland Police Bureau’s Rapid Response Team that Warner had directed a high-powered, green laser into the eyes of numerous law enforcement officers attempting to disperse the riot. Warner resisted arrest, prompting officers to use force. Officers found a black, pen-style laser pointer on Warner’s person. Warner was taken into custody and later released.

The case was recently dismissed.
“The government moves the Court for an Order under Fed. R. Crim. P. Rule 48(a) to dismiss with prejudice the indictment against Defendant, the best interest of justice,” read the December 21 motion filed in U.S. District Court by Acting US Attorney Scott Erik Asphaug.
“Defendant has successfully complied with the terms of the Defendant Resolution Agreement, including performing at least 30 hours of community service,” it added.
Florida Republican Sen. Rick Scott called the decision “an insult to police” in a Twitter post.
“This injustice is an insult to police across America. You attack a cop, you should go to jail. Why won’t Joe Biden’s @TheJusticeDept support law enforcement?” Scott wrote.

Texas Republican Sen. Ted Cruz agreed in a fiery post shared earlier on Thursday.
“Biden DOJ LETS THE TERRORIST GO with a slap on the wrist,” Cruz wrote. “This is WRONG. It is partisan. And political. If you assault a police officer, you should go to jail for a long time. Whatever your politics.”
