This House Democrat Says She Fights For Women. As A Prosecutor, She Let Rapists Walk Free.

Rep. Jennifer Wexton (D., Va.) says she’s worked tirelessly in Congress as a defender of abused women. But as a county prosecutor, Wexton went easy on convicted rapists.

While serving as a Loudoun County prosecutor in 2001, Wexton had three rapists plead to misdemeanors, letting them walk after just months in prison. One man, an illegal immigrant, was charged with raping a woman four times in the same day. Two beat their female victims. Under Virginia law, the men were eligible to serve at minimum five years in prison for each rape.

The records could be a problem for Wexton as Americans are souring on lenient criminal justice policies. Sixty-eight percent of voters list crime as a “very important” issue heading into the 2022 midterms, according to a Harvard CAPS-Harris poll published last week. Wexton is squaring off in November against Republican candidate Hung Cao in the state’s 10th Congressional District. She leads Cao by 2 points, according to an October poll by OnMessage.

A spokesman for Wexton did not respond to a request for comment.

Wexton has touted her prosecutorial record during her congressional campaign, saying in March that she has “fought to support survivors and hold abusers accountable throughout my career.”

But in 2001 alone, Wexton dropped rape charges against three offenders, a “rare” move, according to a former county prosecutor who spoke to the Washington Free Beacon.

Samuel Flores, an illegal immigrant from El Salvador, was charged with four counts of rape and one count of abduction with intent to defile in February 2001, court records show. He also beat his victim. A magistrate held Flores without bond before trial, noting that the weight of the evidence was “good.” But Wexton allowed Flores to plead to one count of sexual battery in April 2001, and he served less than two months before he was released.

Months later, Wexton had Walter Hernandez—who was charged with rape in July 2001—plead guilty to sexual battery as well. He served four months in prison before his release.

Wexton in September 2001 dismissed abduction with intent to defile charges for David Antonio Moya-Guillen, who reportedly punched a woman in the face before he raped her. He was reportedly released
