“This proposed rule is a major step towards fulfilling the law’s full promise and advancing our legal, ethical, and moral charge to provide equitable access to opportunity for all,” Marcia Fudge, Secretary of HUD, said the following:

These new requirements are part of a rule called “Affirmatively Furthering Fair Housing,” These are reasonable because they comply with a 1968 Fair Housing Act provision that required localities “affirmatively further” Fair housing is a solution to historical segregation.

The Affirmatively Furthering Fair Housing Rule was adopted in June 2013 but the compliance portion of the rule had been withheld. Thursday’s update follows through on that aspect of the measure.

New is the requirement that local governments submit equity plans as part of the compliance process. This is in contrast to the Obama version.

Each five-year period, the housing authorities must submit equity plans which include: “analysis of fair housing issues confronting their communities, goals, and strategies to remedy those issues in concrete ways, and a description of community engagement.” The analyses should then be included in their planning documents.
