Arizona Court Upholds State’s Vote-by-Mail System

AAppeal n court In Arizona Upheld the state’s voteAfter the state GOP leaders argued that it violated the state’s election secrecy clause, the Constitution -by Mail System was declared constitutional.

The court upheld a previous ruling by the state Supreme Court in June 20,22 which stated that voting by post did not violate state constitution secrecy clause.

“Arizona’s mail-in voting laws preserve secrecy in voting by requiring voters to ensure they fill out their ballot in secret and seal the ballot in an envelope that does not disclose the voters’ choices,” According to the court, its decision.

The court ruled that the vote by mail system, in which voters request, complete, and drop off their ballots, provides adequate protection “to ensure the preservation of secrecy in voting.”

The law establishing the state’s voting-by-mail system became effective in 1991 when the Grand Canyon State allowed voters to request a vote for any reason. The case was first filed by the Republican Party of Arizona in February 2022. They submitted a special action petition and then filed a claim with state Superior Court.

The court confirmed that the Arizona GOP had the standing to bring the case against vote-by-mail.

The party must follow the same laws for both primary and general election. In its decision, the court did not award the costs or attorneys’ fees of the plaintiff.
