Rep. Gaetz Moves to Abolish the ATF After Latest Attack On the Second Amendment

At any rate, Gaetz is absolutely right to push for abolishing the ATF, though you can be sure the newly Republican Congress won’t pass it. 

The Second Amendment is as clear as day. Anyone can read it. It is not, however. is, It is, after all, a Constitutional Amendment. 

They theoretically have the power to ban certain types of firearms. That power is only available to Congress. It would also require the Amendment process to amend or repeal the Second Amendment. 

For several reasons, Congress is unlikely that they will do so. First, it’s hard work to amend the Constitution. Second, it’s very easy for Congress to create unaccountable agencies that can do whatever they want, and they wash their hands of the situation. 

Third, because in fact, announcing their intention to amend or abolish the Second Amendment could cause problems that we don’t even think about.

The ATF’s “Ruling”

Back to Gaetz’s “final straw,” the ATF’s “ruling” Stabilizing braces is their attempt to ban an increasingly common type firearm. This is essentially pistols that function and look similar to AR and AK platform rifles.

Anyone who is familiar with firearms or the law will tell you that short-barreled guns, also known as SBRs, are common. are Class III firearms that require a host of unconstitutional steps for the prospective owner before they can own one.
