Detransitioner Takes First Legal Action In Spain Against Health Provider That Transitioned Her As A Minor

A woman who has been detransitioned is filing the first legal action in Spain against a healthcare provider that prescribed her hormones when she was a teenager and then removed her eggs as an adult.

Susana Domínguez, 24, Filed a claim Galician Health Service was the Spanish public-funded group that prescribed her cross-sex hormonal therapy at 16, and performed a hysterectomy for her at 19, which she regrets deeply.

Domínguez told El Mundo, Spain’s second-largest printed daily newspaper, that her current condition is “awful,” She feels her life is complete. “ruined.”

This claim is a first step towards a possible lawsuit and asks for 314,000 euros (approximately 3333,000 USD). It alleges that Domínguez was misdiagnosed, did not receive adequate psychological support, and that hormone treatment aggravated her mental health condition.

Domínguez told the outlet that she was 15 when she was introduced to the transgender narrative through YouTube influencers who claimed their mental health improved after transitioning. At age 16, she started receiving testosterone through the public health system. She had a double-mastectomy at 18 years old, which she and her family paid out-of pocket.

When Domínguez was 19, her endocrinologist recommended she have a hysterectomy, also facilitated by the public health service. Shortly after having her uterus removed, Domínguez realized she had made a terrible mistake.

She stated that it took her about six years from the moment she believed she was transgender until she realized that her mental health problems (depression, suicide attempts, and recent discoveries that she might be autistic) had impeded her ability make responsible decisions. 

Domínguez told El Mundo that she is angry with her psychologist because, when she confronted him, he allegedly told her he knew transitioning would not help her. She is now on estrogen therapy as she cannot make it naturally.

Galician law was passed in 2014. It allows patients to take control of their medical transition. An even more radical “Trans Law” Spain recently passed a national law that enforces the following: “affirmative” approach that provides patients with hormone therapy and surgery and prohibits — and even fines — mental health professionals up to 150,000 euros ($159,000 USD) for providing therapy that might relieve their patients’ gender-related distress.

Domínguez has found support from other detransitioners from the Subreddit for DetransThe forum was established in 2017, and has nearly 45,000 members. Her mother is involved with the Spanish parent-led group, The Amanda AssociationThe Advisory Board for Trans-Identifying Children was created to encourage medical professionals to be cautious when treating trans-identifying children. It currently represents around 300 parents in Spain. 

El Mundo reached out the Galician Health Service to get comment. A representative stated that “all protocols were followed” That and more “a clinical committee evaluates each case.” 

Domínguez is the seventh detransitioner worldwide to bring legal action against the medical providers that facilitated her medical transition. Two lawsuits against detransitioners in the United States are currently pending. Michelle Zacchigna The first Canadian detransitioner lawsuit was filed against eight mental health professionals and doctors who she has been treated by since she was 21 years old. She claims they failed to address her complex mental needs and instead allowed for her to self-diagnose herself as transgender. 

Jay Langadinos Australian lawyer is seeking to sue the psychiatrist who allowed her to start medical transition after she claims she was in a mental crisis. Ritchie Herron, who claims Ritchie Herron was in the same situation, is also suing doctors in England for authorizing him to have hormone therapy and genital surgical while he was experiencing mental distress.

Keira Bell, a woman who had been detransitioned in the United Kingdom in 2020, was awarded compensation. She also helped to bring about legislative changes and got the clinic that she underwent sex-reassignment closed down. Bell, who started her transition at 15 years old, was not mature enough at that point to make such an important life-changing choice.

This emerging field of medicine has limited guidance. A small number of studies show that detransition rates vary from 1% to 30 percent. However, little is known about regret in patients who are treated as minors. 

Two studies showed that less than 2% of adults were able to read English.
