The Big Problem With The Stormy Daniels Hush Money Case Against Trump
Donald Trump should plead guilty to a tawdry attempt with a trolly if he is ever indicted. However, the Manhattan District Attorney’s Office is not going to indict him for cheating on his wife with porn star Stormy Daniels. The case is far more complex than his detractors believe.
A case for a criminal indictment can be complicated and, as Trump may say, it has been. “big problems.” Alvin Bragg, DA Alvin Bragg, will eventually convince a jury to hang the scalp of the former president on his office wall. This just doesn’t make sense.
Let us start by giving some background. Daniels claims that she was with Trump in Lake Tahoe in 2006, and they had a fling. In October 2016, as Trump was about to become president, Trump and his closest friends realized that they might be looking at what Bill Clinton called a “fling” in Lake Tahoe. “bimbo eruption.” Trump and Daniels allegedly made a deal to $130,000 each to keep their secret after they kissed.
Hush money is generally not illegal. This is when two people agree not to discuss any events between them. You can call it gross, offensive or sordid. You don’t need to call the police.
There were however some issues with the payment of Daniels by Team Trump. Bragg’s Office claims that Trump’s turncoat fixer Michael Cohen received the money. Cohen was also falsely listed as Cohen’s legal retainer. If they can prove it, the Trump Organization will be charged with misdemeanor falsifying records business records. This would be a disgraceful verdict that would not satisfy liberals who have tried to lock him up ever since the election.
If prosecutors can prove that records were falsified in order to conceal another crime, then the misdemeanor is made a felony. That is what Bragg’s Office appears to be trying for. But what exactly could that second crime be? It was long speculated that it would be illegal under New York election laws. That is, Trump paid Daniels to help him win his bid for the presidency and didn’t report it as campaign expenditure.
This is the problem: Why wouldn’t a well-known businessman and TV star whose every move was published in New York tabloid gossip magazines long before he dreamed about the White House have other reasons for keeping such an embarrassing secret? A porn actor blabbing about a decade old affair would be a great idea for a married man. It’s not only an aspirant politician.
If the payment for the hush money was to be considered only in the context Trump’s campaign, it would mean that anyone could sign a contract with any willing party to not discuss a particular subject You cannot use this site unless They are running for office. Trump’s chances at winning the election the month after Daniels’s public disclosure would be significantly reduced, particularly considering the damage caused by the scandal. “Access Hollywood” Video had already raised questions about Trump’s character, and his fidelity. Citizen Trump was not alone in wanting her story to be kept from the media.
Bragg’s office hasn’t said whether it will file a felony charge, or confirmed its legal theory, but the idea of a grand jury to investigate a misdemeanor against an ex-president seems like a waste of time and a poor decision. Cohen, who pleaded guilty to federal charges in 2018 regarding the payments, was the main witness before the grand jury, which reportedly also heard from another half-dozen people.
Daniels was reportedly willing to testify, but has not yet been called. Trump declined an invitation to testify. Sources close Bragg’s office claim that a true bill could soon be on the horizon. Unlike a criminal trial jury, which must be unanimous to support a conviction, a grand jury can indict with a majority – hence the old legal saw about a prosecutor being able to “indict a ham sandwich.”
If Trump becomes the ham sandwich, Bragg’s office will face a much bigger hurdle when the case goes to trial. Trump’s lawyers are going to argue that Stormy’s payments were a tempest within a teapot. Then again, Trump’s fate may not hinge on arcane interpretations of campaign finance laws. It may be as simple as whether 12 New York jurors want Trump’s scalp as much as Bragg.
