Controversial Nominee for 1st U.S. Circuit Court of Appeals Likely to be Withdrawn by President Biden

President Joe Biden is facing some serious heat from Senate Judiciary Committee members over his nominee for the 1st U.S. Circuit Court of Appeals, Michael Delaney. But it looks like Biden is about to make a move and withdraw Delaney’s nomination due to criticism from both Republicans and Democrats.
Why is Delaney so controversial?
- He allegedly threatened to reveal the identity of a 16-year-old victim of sexual assault while defending St. Paul’s School against her lawsuit.
- He signed a legal brief in 2005 backing a New Hampshire parental notification law for abortion, which raised concerns among Democrats.
The Senate Judiciary Committee skipped over a vote to advance Delaney to the full Senate, despite advancing six other nominees. A coalition of eight progressive groups urged the committee to reject his nomination, citing his unsuitable record for the lifetime appointment.
Republican South Carolina Sen. Lindsey Graham called on the Biden administration to withdraw Delaney’s nomination, and Democratic Connecticut Sen. Richard Blumenthal expressed concerns over his stance on reproductive rights.
