Democrats want to reform the “MAGA Supreme Court” after a ruling supported by all liberal justices.

Supreme Court Unanimously Rules EPA Overstepped Authority

All nine Supreme Court justices, including liberal justices Elena Kagan, Sonia Sotomayor, and Ketanji Brown Jackson, ruled Thursday that the Environmental Protection Agency overstepped its authority in regulating a piece of property near a creek. This is a significant victory for property owners and a blow to the EPA’s power to regulate waters.

However, Democrats have been quick to criticize the ruling, with Senate Majority Leader Chuck Schumer and Rep. Ro Khanna both claiming that the Court’s decision will lead to more polluted water and destruction of wetlands. Schumer even attempted to turn the ruling into a campaign issue, promising to “keep fighting to protect our waters.”

Khanna went further, calling for Court reform and echoing the sentiments of progressive groups who are pushing to pack the Court with left-wing justices. This comes as Democratic megadonor George Soros has ramped up his funding of such groups.

The Details of the Case

In the case of Sackett v. Environmental Protection Agency, Michael and Chantell Sackett sued the EPA for declaring that it could regulate their Idaho property. The agency claimed it had the authority to do so because the property, which is near a ditch that feeds into a creek that in turn feeds into a lake, constitutes “wetlands,” which the EPA can regulate under the Clean Water Act.

The Supreme Court ruled unanimously in favor of the Sacketts, with Justice Samuel Alito writing the majority opinion. The Court found that the EPA went too far in regulating the land and established new limits on what constitutes “wetlands” under the Clean Water Act.

  • The act only gives the EPA authority over wetlands that have “a continuous surface connection” to “the waters of the United States.”
  • Four justices, including the Court’s three liberals and conservative Brett Kavanaugh, disagreed with those limits, arguing that the act also applies to “wetlands separated from a covered water only by a manmade dike or barrier, natural river berm, beach dune, or the like.”

Despite the unanimous ruling, some left-wing politicians and media outlets have overlooked the nuances of the case and criticized the Court’s decision as a blow to environmental protections. It remains to be seen how this ruling will impact future EPA regulations and the ongoing debate over the scope of the Clean Water Act.
