Disney’s First Amendment Lawsuit Against Florida Governor Faces New Judge

The federal judge that was set to oversee Disney’s First Amendment lawsuit filed against Florida Gov. Ron DeSantis recused himself from the high-profile case on June 1 after discovering that a “relative within the third degree of relationship” owns Disney stock.

U.S. Chief District Judge Mark Walker, an Obama appointee, was replaced by Judge Allen Winsor, a Trump appointee who has dismissed multiple lawsuits challenging Florida’s Parental Rights in Education Bill. The case involves Disney’s claim that DeSantis’ executive order banning vaccine passports violates the company’s First Amendment rights.

Walker’s Previous Comments Cause Concern

DeSantis’ lawyers had previously requested that Judge Walker be disqualified from the case, citing comments he made in two unrelated lawsuits that dealt with free speech issues and fear of retaliation. In response, Walker recused himself after discovering that a relative owns Disney stock.

Disney’s lawsuit against DeSantis claims that the governor’s executive order banning vaccine passports violates the company’s First Amendment rights. The case will now be heard by Judge Winsor.

‘Rank Judge-Shopping’

Walker dismissed DeSantis’ motion to disqualify him from the case, calling it “wholly without merit” and “rank judge-shopping.” However, he ultimately chose to recuse himself after discovering the conflict of interest.

The case will continue with Judge Winsor presiding.
