Federal Judge Partially Blocks Indiana Law Protecting Children from Transgender Procedures

A federal judge has issued a preliminary injunction on an Indiana law aimed at safeguarding children from life-altering transgender procedures. The ruling temporarily halts the prohibition on administering puberty blockers and cross-sex hormones to minors, but does not affect the ban on surgeries such as double mastectomies or genital surgeries for girls identifying as boys.

The American Civil Liberties Union (ACLU) filed a lawsuit challenging the law’s constitutionality on behalf of several parents, leading to the injunction. Indiana officials have vowed to defend the law, which was signed earlier this year and was scheduled to take effect on July 1.

“The Court openly acknowledges evidence showing the safety and effectiveness of puberty blockers and hormone therapy are uncertain and unsettled,” said a spokesperson for Indiana Attorney General Todd Rokita. “It also recognizes that the State has shown there are good reasons for regulating gender transition procedures for minors.”

“So, our office will continue to defend the democratically passed laws of the Indiana General Assembly, and we will continue to fight for the children,” the spokesperson added, emphasizing that the federal ruling is not the end of the story.

Indiana is among the 20 states that have taken steps to protect children from life-altering transgender procedures in recent years. The ACLU promptly challenged Indiana’s law after it was signed by Republican Governor Eric Holcomb, following a pattern of similar lawsuits filed in other states.

The ACLU of Indiana’s legal director, Ken Faulk, celebrated the preliminary injunction as a victory for trans youth and their families. Faulk stated, “We won’t rest until this unconstitutional law is struck down for good.”

Aggressive Court Strategy by Supporters of Transgender Procedures on Children

Advocates for transgender procedures on children have pursued an aggressive court strategy, resulting in the blocking of state laws in several states, including Alabama, Arkansas, and Florida.

In Florida, Judge Robert Hinkle issued a ruling against the state’s ban on puberty blockers and cross-sex hormones, using language that some consider activist. In his 44-page ruling, he stated, “The elephant in the room should be noted at the outset. Gender identity is real. The record makes this clear.”

President Joe Biden’s Department of Justice has also taken action, suing the state of Tennessee over its ban on transgender procedures.
