Flaherty’s departure comes amidst a lawsuit filed by Republican attorneys general of Missouri and Louisiana, accusing the Biden administration of violating the First Amendment through social media censorship. The evidence presented by the plaintiffs has led to the approval of depositions for eight officials, including Flaherty, who are believed to be involved in the administration’s censorship campaign.
While Flaherty’s imminent departure means he will no longer be a defendant in the lawsuit, his successor will take his place once named. President Biden acknowledged Flaherty’s departure without providing specific details about the timing, hinting at future collaboration.

Judge to Decide If Government Improperly Censored Social Media Users
In a March ruling, the judge overseeing the lawsuit against the Biden administration refused to dismiss the case, finding the free-speech claims made by Louisiana and Missouri plausible and deserving of further litigation. The judge also allowed the plaintiffs to gather evidence, including email communications between the White House and social media companies.
While there are other lawsuits accusing the Biden administration of censorship-by-proxy, this particular case has made significant progress. The judge stated that the suit revolves around allegations of coercion by the Biden administration and government agencies, urging social media companies to censor viewpoints and speakers disliked by the Left.
