Supreme Court to Hear Pivotal Gun Rights Case
The Supreme Court has agreed to take up a case that revolves around the rights of convicted domestic abusers to own firearms. This decision, announced in an order list released on Friday, has significant implications for gun control laws in the United States.
The case, titled “United States of America v. Zackey Rahimi,” centers around Rahimi, a convicted felon who was involved in several shootings in the Arlington, Texas area between 2020 and 2021. Rahimi had a restraining order against him from his former girlfriend, according to the Washington Examiner.
Rahimi appealed against a law implemented by the Biden administration in 2022, which prohibits individuals with domestic violence restraining orders from owning guns. The Supreme Court has now agreed to hear this case, signaling its importance in shaping gun control policies.
In 2019, Rahimi assaulted his former girlfriend, leading her to file a restraining order against him. However, he disregarded the court order and continued to threaten other women. Eventually, he committed five separate shootings, and authorities discovered multiple firearms in his home, in violation of the law, according to The New York Times.
During his trial, Rahimi argued that he had the right to possess firearms. However, the judge rejected his Second Amendment challenge, and Rahimi ultimately pleaded guilty to the shootings. He was subsequently sentenced to over six years in prison.
Rahimi appealed the decision to the Fifth Circuit, which initially ruled against him in June 2022. However, the court later reversed its decision in March, stating that the law did indeed infringe upon the Second Amendment due to the absence of historical precedent.
The ruling by the appeals court came after the Supreme Court established a new test in June, focusing on historical analogues to determine the constitutionality of gun control laws, as reported by the Times.
The case of United States v. Rahimi presents an opportunity for the Supreme Court to explore the scope of this new test and evaluate the government’s justification for laws that limit Second Amendment rights.
Almost a year after the Supreme Court introduced this new approach in the case of New York State Rifle & Pistol Association v. Bruen, the justices will now hear the Biden administration’s appeal.
According to the Times, the Supreme Court often considers appeals of decisions that declare federal laws unconstitutional.
