Lawsuit alleges Garland, DOJ neglected Hunter Biden’s foreign agent registration during Burisma tenure.
America First Legal (AFL) Sues DOJ for Failure to Hold Hunter Biden Accountable
America First Legal (AFL) has taken legal action against Attorney General Merrick Garland and the U.S. Department of Justice. AFL alleges that Hunter Biden was not required to register under the Foreign Agent Registration Act (FARA) during the Obama administration, despite evidence of his representation of Ukrainian energy company Burisma.
According to AFL, Hunter Biden’s role as a board member of Burisma and his position as an attorney representing the company make him an “agent of a foreign principal” under FARA. AFL argues that he should have been required to register as such.
Under FARA, an “agent of a foreign principal” includes anyone who acts on behalf of a foreign principal or whose activities are supervised, directed, controlled, financed, or subsidized by a foreign principal. AFL claims that Garland failed to enforce FARA registration requirements for Hunter Biden.
Furthermore, recent email correspondence released by the National Archives confirms Hunter Biden’s involvement in a phone call between his father, then-Vice President Joe Biden, and former Ukrainian President Petro Poroshenko.
AFL points out the discrepancy in treatment between Hunter Biden and others who have been indicted for failing to register as foreign agents. While U.S.-Israeli dual citizen Gal Luft was indicted for his activities on behalf of a Chinese energy company, Hunter Biden has not faced similar consequences for his business relationships with the same parties.
The Senate Committee on Homeland Security and Governmental Affairs and the Senate Committee on Finance have previously released investigative reports outlining the financial arrangements between the Biden family and their Chinese business partners.
In addition, digital communications obtained by the House Ways and Means Committee revealed Hunter Biden’s explicit mention of his father’s involvement in his dealings with Chinese nationals.

The Biden family’s repeated use of their name and connections to benefit financially from foreign entities raises concerns about their influence and potential conflicts of interest. AFL accuses Garland and the DOJ of providing special treatment to Hunter Biden and failing to ensure transparency and accountability.
Gene Hamilton, vice president and general counsel at AFL Legal, emphasizes Garland’s duty to enforce FARA registration for Hunter Biden and shed light on his activities on behalf of foreign principals.
Recent revelations have also cast doubt on the integrity of the DOJ, as whistleblower statements suggest interference by federal prosecutors and the FBI in an IRS investigation of Hunter Biden. This has led to calls for a restructuring of the FBI to address ideological bias.
Despite mounting evidence, Garland denies any preferential treatment given to Hunter Biden by the DOJ.
