Republicans Prepare for Battle Over Supreme Court Regulation Bill
“Tomorrow will be one hell of a fight,” Sen. Lindsey Graham (R-S.C.) said at a late afternoon press conference in the U.S. Capitol on July 19.
“The effort by the Left to destroy the Court in the eyes of the public is one of the most dangerous things I’ve seen since I’ve been here.”
Sen. Graham’s strong words set the stage for a heated showdown as the Senate Judiciary Committee prepares to vote on the proposed Supreme Court Ethics, Recusal, and Transparency Act (SCERT) of 2023 (S.359). Introduced by Sen. Sheldon Whitehouse (D-R.I.), the bill aims to establish a code of conduct for Supreme Court justices and allow the public to file complaints against them for violating the code or engaging in conduct that undermines the Court’s integrity.
Republicans argue that this complaint mechanism is a deliberate attempt to hinder the Court’s functioning. They are determined to protect the constitutional separation of powers and prevent the Supreme Court from being destroyed.
Democrats, on the other hand, have been demanding a code of ethics for the Court due to alleged ethical lapses by conservative justices, such as Justice Clarence Thomas and Justice Samuel Alito. They are particularly outraged by the revelations of wealthy Republican donor Harlan Crow’s gifts to Justice Thomas and Justice Alito’s failure to disclose a paid trip.
While Democrats have been less vocal about similar allegations against liberal Justice Sonia Sotomayor, the focus remains on the need for transparency and accountability within the highest court in the land.
Sen. Durbin Stresses the Importance of the Bill
Hours before Sen. Graham’s press conference, Senate Judiciary Committee chairman Dick Durbin (D-Ill.) emphasized the significance of passing the bill.
“Just about every week now, we learn something new and deeply troubling about the justices serving on the Supreme Court—the highest court in the land in the United States—and their conduct outside the courtroom,” Mr. Durbin said.
