The state of New Jersey has taken a bold step by filing a court challenge against New York’s congestion pricing plan.”>highly controversial congestion pricing plan. This plan aims to charge drivers up to $23 to enter central Manhattan during peak hours, sparking a heated debate.
The lawsuit specifically challenges the U.S. Department of Transportation and the Federal Highway Administration’s decision to approve the congestion toll using an environmental assessment review process instead of a more comprehensive environmental impact statement (EIS).
A Call for a Thorough Environmental Review
Governor Phil Murphy, a vocal critic of the plan, has expressed his concerns about the lack of a thorough environmental impact statement. He argues that the Biden administration ignored his requests for an EIS, despite the National Environmental Policy Act calling for one when a project is deemed to have significant environmental effects.
“We believe the normal review process was bypassed by the federal government,” Governor Murphy stated in an interview on Good Day New York.
Instead of an EIS, a shorter environmental assessment was conducted for the New York City congestion pricing plan. Although nearly 1,000 pages long, this assessment concluded that there would be no significant impact.
