Federal Judge Dismisses Donald Trump’s Defamation Countersuit
A federal judge in New York has made a significant ruling in the ongoing legal battle between former President Donald Trump and writer E. Jean Carroll. Carroll has accused Trump of raping her in the mid-1990s, and Trump filed a defamation countersuit against her. However, U.S. District Judge Lewis Kaplan has now dismissed Trump’s claim, stating that Carroll’s statements were “substantially true.”
“We are pleased that the Court dismissed Donald Trump’s counterclaim,” said Carroll’s attorney, Roberta Kaplan. “That means that the January 15th jury trial will be limited to a narrow set of issues and shouldn’t take very long to complete. E. Jean Carroll looks forward to obtaining additional compensatory and punitive damages based on the original defamatory statements Donald Trump made in 2019.”
The ruling comes after Carroll’s legal team argued that her statements about Trump were true, and the jury’s finding on the “sexual abuse question” supported her claims. Judge Kaplan agreed with this argument, noting that New York penal law defines rape as forcible penetration of the vagina by a penis.
Trump, who has consistently denied Carroll’s allegations, has appealed the jury’s verdict that ordered him to pay $5 million in damages. His legal team filed the defamation countersuit in an attempt to challenge Carroll’s disregard for the jury’s finding.
“We strongly disagree with the flawed decision and will be filing an appeal shortly,” said one of Trump’s attorneys, Alina Habba.
In addition to this ongoing legal battle, Trump is also facing multiple indictments on the state and federal levels. Despite these challenges, he is currently running a campaign for a second term in the White House, maintaining his denial of any wrongdoing and claiming to be the victim of a “witch hunt.”
Deposition to be Given to Manhattan District Attorney
In a separate order, Judge Kaplan has ruled that Carroll’s legal team can provide Trump’s deposition to Manhattan District Attorney Alvin Bragg. This deposition is related to the criminal case involving hush-money payments to adult film actress Stormy Daniels.
