Trump’s Attorneys Argue Against Overbroad Protective Order
In their argument, Trump’s attorneys claim that Smith’s protective order, typically used by prosecutors to govern the handling of discovery in a case, is “overbroad.” They further accuse the Department of Justice of attempting to “restrict First Amendment rights.”
Trump’s defense team asserts that protecting certain discovery does not necessitate a “blanket gag order” on all government-produced documents. Instead, they propose a more limited protective order that would safeguard genuinely sensitive materials. This alternative, they argue, would satisfy any government interest in confidentiality while preserving President Trump’s First Amendment rights and those of the public.
