The Trial Against Hunter Biden: A Major Development in the Criminal Case
The criminal case against President Joe Biden’s son Hunter Biden is taking a dramatic turn as plea negotiations have fallen through, leading to an upcoming trial, according to prosecutors. U.S. Attorney David Weiss, who was appointed under President Donald Trump, stated in a filing that ”The Government now believes that the case will not resolve short of a trial.”
This latest development comes after lawyers for Hunter Biden were asked to provide his position on the request, with a deadline of August 11. However, the defendant requested more time, which was declined by the government. As a result, Hunter Biden’s position has still not been provided.

Previously, Hunter Biden had agreed to plead guilty to two counts of intentionally not paying taxes, as announced by Mr. Weiss in June. The plea deal also included a pretrial diversion agreement for a gun charge. However, during a hearing in July, the parties disagreed on certain aspects, and Hunter Biden ultimately pleaded guilty.
During the hearing, it was revealed that Hunter Biden was set to receive extensive immunity under the deal. However, attorneys for the government and Hunter Biden were unable to provide precedent for such an agreement when questioned by U.S. District Judge Maryellen Noreika.
In a new filing, Mr. Weiss has asked Judge Noreika, another appointee of President Trump, to dismiss the case. However, if the request is granted, prosecutors have stated that they may bring the same charges or different ones in another district.
Additionally, prosecutors have asked the judge to vacate her order for the parties to brief her on aspects of the plea agreement, as the case is no longer moving towards a guilty plea.
Appointment of Special Counsel and Whistleblower Allegations
In a separate development, Attorney General Merrick Garland, appointed by President Joe Biden, has appointed Mr. Weiss as special counsel. This appointment aims to provide Mr. Weiss with the necessary resources to continue the investigation into Hunter Biden.
Whistleblowers have alleged that Mr. Weiss disclosed during a meeting that he had attempted to bring charges against Hunter Biden in California and Washington, but prosecutors in those states rejected the efforts. These allegations are supported by documents, including internal IRS emails.
According to one of the whistleblowers, IRS agent Gary Shapley, Mr. Weiss stated during a 2022 meeting that he was not the ultimate authority on charging decisions. He also allegedly mentioned that he had requested to be appointed as a special counsel, but the Department of Justice denied the request.
The trial against Hunter Biden is a significant development in the ongoing criminal case, and it remains to be seen how it will unfold in the coming months.
