New Federal Rule Could Impact Private Gun Sales
Gun owners may soon face restrictions on selling their firearms privately, according to a leaked plan from the Bureau of Alcohol, Tobacco and Firearms (ATF). The proposed rule would require gun owners to obtain a Federal Firearms License (FFL) in order to sell firearms for a profit. The Biden administration aims to implement this rule in 2024 without new legislation from Congress.
The ATF plans to use the existing Bipartisan Safer Communities Act (BSCA) to justify cracking down on private gun sales. Under this act, individuals who trade guns to predominantly earn a profit are considered “gun sellers” and would be subject to the FFL requirement. This move has received support from some Republicans, despite objections from Second Amendment advocates.

This rule would have a significant impact on online marketplaces where gun owners trade firearms, as it would prevent them from selling guns for more than their purchase price. Everyday gun owners, who may be unaware of the change in the law, could potentially face criminal charges for selling guns without the proper licensing. Additionally, the concentration of gun sales among a limited number of FFL licensees could lead to higher prices for purchasers.
The Department of Justice and ATF officials are collaborating to draft the rule, with plans to formally enact it in the second half of 2024. President Joe Biden has been critical of online trade in firearms and has expressed a desire to ban the practice entirely through legislation.

Legal challenges are expected if the ATF attempts to regulate private gun sales administratively. A recent federal appeals court decision already struck down the ATF’s bid to regulate pistol braces. It remains to be seen how this new rule will fare in the face of potential legal opposition.
