The U.S. Navy is currently without a Senate-confirmed chief of staff, making it the third military service to face this issue. The confirmation process has been stalled due to an impasse over the military’s abortion policies.
Recently, Chief of Naval Operations Adm. Mike Gilday retired from his position, leaving a vacancy that needs to be filled. President Joe Biden has nominated Adm. Lisa Franchetti to replace Adm. Gilday as the Chief of Naval Operations. However, Adm. Franchetti is currently serving in an acting capacity until her confirmation.

The timeline for Adm. Franchetti’s confirmation remains uncertain. Senator Tommy Tuberville has placed a hold on the process, objecting to a Department of Defense (DOD) policy that funds travel and leave for military service members seeking abortions.
Under current federal laws, federal funds are prohibited from being used for abortions, except in cases where the mother’s life is at risk or the pregnancy is a result of rape or incest. The DOD argues that its policy on abortion-related travel is an exception to these rules, but Senator Tuberville disagrees and insists on holding nominations until the DOD retracts the policy or Congress takes action to change the laws.
While Senator Tuberville’s hold prevents large-batch confirmations, the Senate can still confirm nominees through regular procedural rules, albeit at a slower pace. Secretary of Defense Lloyd Austin acknowledged the delay during Adm. Gilday’s retirement ceremony, emphasizing the importance of swift transitions in leadership for the defense of the United States.
Notably, the Marine Corps and the Army are also currently without Senate-confirmed chiefs of staff due to the impasse over the abortion policy.
Despite pressure from the Biden administration and Senate Democrats, Senator Tuberville shows no signs of lifting his hold without a reversal of the DOD’s abortion travel policy. President Biden has criticized Senator Tuberville for jeopardizing U.S. security and expressed willingness to talk if there is a possibility of resolving the issue. However, Senator Tuberville has questioned the administration’s commitment to finding a solution and highlighted his longstanding concerns about the abortion policy.
The continued delays in the confirmation process have sparked discussions about the impact on military leadership and the need for resolution.
