South‌ Carolina Supreme Court Upholds Revised Abortion⁣ Ban

The South Carolina Supreme Court has made a ‍significant ‍ruling, upholding a revised version of ‍the state’s ban on abortions after⁣ six weeks ‍of pregnancy. This decision‍ comes after​ a ‌previous ruling earlier this year that deemed ‌the law​ unconstitutional.

In a 4-1⁤ decision, the court ‌stated that South Carolina’s constitutional protection against “unreasonable invasions of⁢ privacy” does not ‌include abortion. They argued that the state law is “within the zone of reasonable ⁤policy‌ decisions rationally related to the State’s interest in protecting the unborn.”

Justice ⁣John Kittredge, in​ a 51-page ‌decision,⁣ wrote, “The ‌legislature has ⁤made a policy determination that, at a certain point in the pregnancy, a woman’s interest in autonomy and privacy​ doesn’t outweigh the interest of the unborn child to live.”

The court ruled in favor of ‌a ⁤revised version of ​the Fetal Heartbeat and‌ Protection from Abortion Act, which had been temporarily blocked earlier this year. The‌ legislation was signed into law by Republican Governor Henry McMaster with overwhelming support from⁣ state lawmakers.

Governor McMaster expressed‌ his satisfaction with the ruling, stating, “With this victory, we protect the ⁤lives of countless unborn children​ and reaffirm South Carolina’s place as one of the most pro-life ⁢states in America.”

Controversial Law and Reactions

The law prohibits abortions after a fetal heartbeat has been detected, with ​exceptions for rape or⁢ incest during⁤ the first⁤ 12 weeks of pregnancy, medical emergencies, or fatal fetal anomalies. Violators of the law‌ could face fines of up to $10,000 and imprisonment for two ‌years.

Planned Parenthood South Atlantic, the Greenville Women’s Clinic, and two doctors filed a lawsuit against the state in response to the revised law. Jenny Black, president and CEO of Planned Parenthood South Atlantic, criticized ‍the decision, stating that it puts “the dangerous politicization of South Carolina’s highest court on full display” and will cause ⁣”irreparable harm” to ​South⁤ Carolinians.

Abortion laws vary across states,⁤ with more than a dozen states banning abortion ‍throughout different stages of pregnancy. ⁤However, certain restrictions in some ⁣states ‌are currently not in⁣ effect ‍due ⁣to‌ legal challenges. ⁢Since​ the landmark ruling of Roe v. Wade, at ​least 15 states have completely‍ banned ⁢abortion, according to ‍the Guttmacher Institute.
