CNN Legal Analyst: New York Attorney General’s Civil Fraud Case Against Trump Weak Due to Lack of Victims
In a recent segment on “CNN This Morning,” CNN Senior Legal Analyst Elie Honig discussed the civil fraud case brought by New York Attorney General Letitia James against former President Donald Trump. Honig argued that the case was weak because there were no victims involved, meaning no one was actually defrauded.
James’ office alleged that Trump had inflated his net worth by up to $2.2 billion in a single year, making it a significant case involving hundreds of millions of dollars. However, Honig pointed out that this was only the fifth-most important case Trump was facing, with four criminal cases taking precedence.
During the deposition, Trump claimed that he could have even doubled or tripled the value of his assets due to the Trump name. Honig acknowledged that Trump had indeed inflated his assets, but the problem with the case was that the banks involved in making the loans had conducted their own due diligence and decided to proceed. They were ultimately repaid with interest, resulting in profits for the banks.
While technically constituting fraud, Honig argued that the lack of a clear victim made the case less appealing as a criminal matter. He concluded, “So technically, is it fraud? Yes. But you don’t really have a victim, which makes it less appealing as a criminal case.”
