Sen. Tim Kaine (D-VA) passionately defended the notion that former President Donald Trump’s involvement in the Jan. 6 Capitol riot could potentially disqualify him from holding office under the 14th Amendment. Speaking on ABC’s “This Week,” Kaine described the attack as a deliberate attempt to disrupt the peaceful transfer of power outlined in the Constitution. He believes there is a strong case to be made, acknowledging that the issue will likely be resolved in the courts.

Meanwhile, Kaine is not alone in his examination of whether the 14th Amendment could prevent Trump from seeking reelection in 2024. Democratic lawmakers and legal scholars, including Rep. Jamie Raskin (D-MD), have expressed similar views. Even former Arkansas Gov. Asa Hutchinson, a Republican, warned that the clause could potentially keep Trump off the ballots during the first Republican presidential debate in Milwaukee.
Section 3 of the 14th Amendment explicitly states that anyone who has taken an oath to uphold the U.S. Constitution cannot have engaged in insurrection or rebellion against it, or provided aid or comfort to its enemies. Kaine emphasized the specificity of the language, highlighting that it refers to insurrection against the constitution itself, not just the United States.
However, critics argue that Trump cannot be disqualified from holding office under the 14th Amendment because he has not been convicted in a court of law or by Congress for participating in an insurrection or rebellion.
Multiple states, including Arizona, Michigan, and New Hampshire, are preparing to counter legal efforts to remove Trump from the ballot based on the 14th Amendment. Lawsuits have been initiated in these states, with members of the Republican Party vowing to fight to keep Trump’s name on the ballot. Chris Ager, a Republican state committeeman in New Hampshire, affirmed their determination to use all available tools to prevent anyone’s access from being denied on the ballot.
