NASCAR Removes Racial Requirement from Diversity Internship Program
In a move that has garnered attention, NASCAR has eliminated a discriminatory racial requirement from their ”diversity internship program” following a report from The Daily Wire.
The stock car racing giant previously mandated that applicants for the internship program must belong to specific non-white “minority classifications.” However, after experts deemed this provision as “blatantly illegal” discrimination, NASCAR promptly removed it.
“Be a member of one or more of the following races/ethnic minority classifications: Black or African American, American Indian or Alaska Native, Asian, Latino or Hispanic, Native Hawaiian or Other Pacific Islander,” read the requirement, which no longer appears on the job post.
Despite not responding to requests for comment, NASCAR’s decision to remove the discriminatory requirement aligns with legal experts’ opinions. David Bernstein, a professor at George Mason University’s Antonin Scalia School of Law, stated that the provision was “blatantly illegal” and potentially violated Title VII and the 1866 Civil Rights Act. He further emphasized that an applicant who was unable to apply due to their race would have grounds to sue NASCAR.
While NASCAR has made changes to the internship requirements, it is worth noting that the racing league still maintains other diversity programs that seemingly discriminate based on race.
The internship was part of a larger campaign called “drive for diversity,” which also encompasses the “driver development program” and the “pit crew development program.”
The driver development program is specifically designed for ”top minority and female drivers,” while the pit crew development program targets “aspiring minority and female pit crew members.” These programs have not been altered.
According to the program requirements, participants must either be female or a “member of one or more… ethnic minority classifications,” including African American, Asian, Hispanic or Latino, Native American, Native Hawaiian or Pacific Islander, and individuals of two or more races.
