Trump requests judge to postpone New York Trump Organization case, arguing against a chaotic start.
Attorneys for former President Donald Trump are making a bold move in the multimillion-dollar civil lawsuit brought against him and his sons by New York Attorney General Letitia James. They have requested a delay in the trial, which is set to begin on October 2nd.
In a filing on Tuesday evening, the attorneys argued that “a trial of this magnitude should not begin in chaos.” They emphasized the importance of knowing the claims and issues to be tried well in advance to adequately prepare for trial.
Their request is for a brief delay, pushing the trial start date three weeks later, closer to the end of October. They hope that by that time, the judge will have ruled on arguments regarding requests for a summary judgment.
New York Attorney General Letitia James has accused President Trump of inflating the value of several properties, defrauding banks and insurers. She is seeking $250 million in damages and wants to prevent him from doing business in the state. President Trump vehemently denies these claims and accuses James of defamation.
In response, President Trump’s legal team has tried to have the case dismissed, arguing that the alleged deals took place too long ago to be brought to court now. They have even released a transcript of a seven-hour deposition where President Trump answered questions about the value of his properties and his role in the business.
However, James is not backing down. In a recent filing, she requested the judge to sanction the defendants and their lawyers for repeating arguments that had already been rejected. The Trump attorneys, on the other hand, asked for the withdrawal of what they deemed a ”frivolous” motion for sanctions.
The lawsuit also involves President Trump’s adult sons, Donald Trump Jr. and Eric Trump. Ivanka Trump, however, has been dismissed from the suit. President Trump has consistently maintained his innocence and believes the case is politically motivated.
Countersuit, Delay Requests
Both countersuit and previous delay requests from President Trump’s side have failed.
Letitia James initially filed the case against President Trump in September 2022. He later attempted to move it to federal court and requested a pause in the proceedings. However, these motions were denied.
President Trump’s attorneys argued that James’ investigations were not driven by legitimate law enforcement goals but rather by political animus. They claimed that her mission was to harass and retaliate against a political opponent.
In January, President Trump dropped the case. On the same day, Judge John Middlebrooks, an appointee of President Bill Clinton, sanctioned him and his attorney for $900,000 over what he deemed a “frivolous” lawsuit against Hillary Clinton and others regarding “Russiagate” claims.
Judge Middlebrooks criticized President Trump for a “continuing pattern of misuse of the courts” and warned that the lawsuit against James was “vexatious and frivolous.”
In March, a request to delay the case was also rejected. The lawyers argued that the complexity and volume of evidence required more preparation time, but Judge Arthur Engoron disagreed, stating that the case was not complicated, only complex.
President Trump’s legal teams have been seeking delays in several other cases, often aiming for trials to take place after the 2024 elections.
