Federal Judge Orders Texas to Remove Border Barriers
A federal judge has issued a ruling ordering the state of Texas to remove barriers from the Rio Grande that were put in place by Governor Greg Abbott to deter illegal migrants from entering the state. The Biden administration filed a lawsuit against Abbott, arguing that he did not have permission from the federal government to place the buoys on the border between the U.S. and Mexico.
In his 42-page preliminary injunction order, Judge David Ezra directed the state to remove the barriers from the river by September 15. Ezra stated that Abbott needed permission to place the floating barriers in the Rio Grande as they obstructed a U.S. navigable waterway in violation of federal law.

The judge also highlighted that the water barrier raised international relations issues with Mexico, which fall under the purview of the federal government. Ezra mentioned that Mexican officials had expressed concerns about the barrier and its potential impact on human life in the Rio Grande.
As this ruling is a preliminary injunction and not a final decision, Ezra only ordered the buoys to be removed from the main waters of the Rio Grande to the riverbank, ensuring they do not impede navigation along the river.
Abbott’s office responded to the ruling, blaming the Biden administration’s failure to secure the border for Texas’ actions. The governor vowed to appeal the ruling all the way to the U.S. Supreme Court if necessary.

Abbott expressed confidence that the ruling would be overturned on appeal and affirmed that other measures to secure the border, such as deploying the Texas National Guard and state troopers and erecting barriers, would continue.
This ruling marks the beginning of a battle to defend Texas’ authority to protect lives from the chaos caused by President Biden’s open border policies, according to the governor.
