The Lawyer for Sidney Powell Fights to Clear Her Name in Georgia Criminal Case

The lawyer representing Sidney Powell is ⁢working tirelessly to ‍remove her from ‍the criminal case involving former President Donald Trump in Georgia. Brian Rafferty, Powell’s attorney, argued in the Fulton County court that she had minimal involvement in the activities mentioned in‌ the indictment.

“The way the government has characterized that, the ⁣evidence is going to show they’re incorrect,” he said.

The indictment, filed on August 14 ‌by Fulton​ County District Attorney Fani Willis, alleges that President Trump, Sidney Powell, ‌and 17 others conspired to commit racketeering by challenging the 2020 election results. The charges primarily focus on their ⁤attempts to⁢ establish alternative slates of electors in various states,⁢ including Georgia, with the intention ‍of disrupting the counting of electoral votes by Congress.

While​ Powell is not ​accused of participating in these activities, she is charged with engaging a⁣ data forensic company⁣ to access and copy ​data from election machines and computers in Coffee County, Georgia, without ​authorization on January 7, ⁤2021.

“There’s a lot of public documents‌ that are ​out there that⁤ demonstrate that numerous folks associated with Coffee County authorized that visit,” Rafferty argued.

Rafferty’s argument revolves around the belief that the election equipment access ‍was authorized, ‌or at least Powell and the individuals involved believed it was. He claims that⁤ there is evidence ⁣to support this, including ⁢the unanimous ⁣permission granted by the Coffee⁣ County Election Board for the forensic inspection.

Furthermore, Rafferty asserts that Powell ⁣was not the driving force behind these actions, suggesting that other lawyers, not mentioned in the case, played a more significant role.

“We submitted a Brady request [for exculpatory evidence] already to the [prosecutors] before this hearing asking for a ⁤host of ⁤different⁤ kinds of exculpatory material we believe the government has that ​will⁢ show that, that will show that she was not ‌the person that was behind this ⁣as has been alleged in this indictment,” Rafferty stated.

Rafferty also challenges the allegation of a written contract, ​pointing out that Powell’s name appears⁢ on a contract she never⁢ signed, and it pertains to another state, not Coffee County.

As the case proceeds, Rafferty requested ⁢that Powell be tried separately⁤ to prevent evidence presented against other co-defendants from prejudicing the jury against her.

It is ​clear that ⁤Rafferty‌ is‍ determined to prove Powell’s innocence and disassociate her from the more complex aspects of the case, focusing solely on her alleged involvement in Coffee County.
