California Bill Raises Concerns Over Parental Rights in Custody Disputes
California may soon require judges to consider a parent’s support for their child’s “gender identity” during custody battles, sparking worries among advocates who fear that parents could lose custody if they do not agree with their child’s claims of being transgender.
The recently passed Democrat-backed bill, AB 957, has raised concerns among conservative groups and California Republicans. If signed by Governor Gavin Newsom, the bill would mandate judges to evaluate whether a parent affirms their child’s gender identity, among other factors, when making custody decisions.
According to the bill, a parent’s affirmation of their child’s gender identity or expression is considered essential for the child’s overall well-being and must be taken into account during custody disputes.
Assemblymember Lori Wilson explained that affirmation could include providing gender-targeted toys, nail polish, and hair length, as reported by the Associated Press.
Opponents of the bill argue that it undermines parental rights and can be easily manipulated. The California Family Council expressed concerns that parents who do not affirm their child’s chosen gender identity risk losing custody.
Critics also worry about potential abuse of the system, where parents may use gender as a means of retaliation against each other. Attorney Erin Friday questioned whether the parent willing to facilitate more transitioning would prevail in such cases.
Elon Musk Voices Concerns
Billionaire entrepreneur Elon Musk, who has previously expressed criticism of transgender ideology, called the bill dangerous. He argued that it effectively penalizes parents who disagree with sterilizing their child, labeling it as “utter madness!”
