At least six states are facing a heated battle between Democrats and conservatives who are determined to keep former President Donald Trump off the 2024 ballot by disqualifying him under the 14th Amendment.
Election officials in Alaska, Maryland, Michigan, New Hampshire, New Mexico, and Rhode Island have confirmed that they are aware of legal discussions surrounding the use of the 14th Amendment to prevent Trump from running in their respective states.
Conservative Legal Scholars and Critics Weigh In
Some conservative legal scholars and critics of the former president argue that the 14th Amendment prohibits individuals who have engaged in insurrection against the United States or have provided aid to its enemies from holding office again. They believe Trump’s efforts to overturn the 2020 election, for which he is facing state and federal indictments, meet these criteria. Trump, however, denies any wrongdoing in either case.
Kelly Howard, the chief of staff to Lt. Gov. Nancy Dahlstrom (R-AK), stated that Alaska’s Division of Elections is aware of the arguments and will consider them if necessary.
Advocacy groups, such as Free Speech for People, have sent letters to top election officials in nine states, while the Citizens for Responsibility and Ethics in Washington has filed a lawsuit in Denver. The legal discourse surrounding the 14th Amendment’s applicability to disqualify Trump has gained significant attention.
Michigan and New Mexico: Battleground States in the Fight

Michigan Secretary of State Jocelyn Benson revealed that conversations about preparing for legal challenges to Trump’s candidacy began over a year ago. She emphasized that these discussions are ongoing and that multiple decision points will arise throughout the election cycle.
Trump’s Response and Criticism
Trump has dismissed the disqualification movement as a political “trick” with no legal standing. His campaign spokesman, Steven Cheung, accused Joe Biden, Democrats, and Never Trumpers of being afraid of Trump’s potential success in the general election. Cheung argued that the efforts to disqualify Trump are baseless and driven by political motives.
