The Biden Administration Seeks Supreme Court Intervention in Big Tech Censorship Case
The Biden administration has made a significant move in the ongoing battle over online censorship by requesting the Supreme Court to halt an appeals court ruling. This ruling found that key officials had “coerced” Big Tech companies into engaging in censorship practices.
The Justice Department has asked the high court to stay the injunction imposed by the U.S. Court of Appeals for the 5th Circuit. This injunction upheld a portion of a federal district court ruling that limited communication between several administration officials and social media companies regarding content moderation.
Challenging the Overreach
Solicitor General Elizabeth Prelogar, representing Surgeon General Vivek Murthy, argued that the injunction entered by the lower courts was overly broad, even if the respondents had standing and a likelihood of success on the merits. The filing emphasized the need to address the excessive scope of the ruling.
A three-judge panel unanimously upheld key portions of a preliminary injunction against federal interference with content moderation on social media platforms. The panel agreed that officials, including Murthy, the Centers for Disease Control and Prevention (CDC), and the FBI, had exerted pressure on platforms to suppress speech deemed dangerous or misleading.
The 5th Circuit also concluded that the injunction issued by U.S. District Judge Terry Doughty in July was overly expansive, encompassing too many agencies.
Supreme Court’s Involvement
Earlier this week, the Supreme Court scheduled the case, Missouri v. Biden, for consideration on October 6. The justices will decide whether to grant a writ of certiorari, which would allow for oral arguments.
The lawsuit, filed by former Missouri Attorney General Eric Schmitt and Louisiana Attorney General Jeff Landry, alleges collusion between the federal government and social media giants like Twitter and Meta to suppress freedom of speech.
