Democrat New Mexico Gov. Michelle Lujan Grisham Stands Firm on Gun Carry Restrictions Despite Temporary Block
Democrat New Mexico Governor Michelle Lujan Grisham is resolute in her efforts to impose a 30-day emergency order limiting the carrying of firearms in public. This comes even after a
federal judge temporarily blocked the enforcement of the order.
Last week, Governor Lujan Grisham attempted to implement the firearms restriction through a public health emergency declaration, which sparked a series of lawsuits challenging its legality. However, U.S. District Court Judge David Urias, appointed by President Joe Biden, issued a
temporary restraining order blocking parts of the governor’s emergency order. These parts specifically prohibited individuals from carrying firearms in public in Albuquerque and Bernalillo County for self-defense.
In response to the court order, Governor Lujan Grisham stated, “Today a judge temporarily blocked sections of our public health order but recognized the significant problem of gun violence in this state, particularly involving the deaths of children. I refuse to be resigned to the status quo. As governor, I see the pain of families who lost their loved ones to gun violence every single day, and I will never stop fighting to prevent other families from enduring these tragedies.”

The emergency declaration would have allowed law enforcement officers to issue “civil administrative penalties” for violators. Despite the temporary restraining order blocking these penalties, Governor Lujan Grisham stated that her administration would continue by increasing law enforcement presence in Bernalillo County and apprehending violent offenders with outstanding warrants.
Although Judge Urias’s decision is a setback for her gun control order, Governor Lujan Grisham expressed that she has seen a significant increase in attention towards addressing gun violence since enacting the emergency declaration.
Governor Lujan Grisham also called on state and local leaders to continue advocating for new policies on guns and gun violence. She wrote, “Who will stand up to protect families and children? I will. And I call on leaders across the state, from local law enforcement to the Legislature to mayors and county commissioners: Stand with me to enact solutions that save people’s lives. Throwing up our hands is not an option.”
The temporary restraining order will remain in effect until at least October 3, the date scheduled for additional arguments in one of the lawsuits challenging Governor Lujan Grisham’s emergency declaration.

Gun Rights Groups Celebrate Ruling

Cody J. Wisniewski, the general counsel and vice president for the Firearms Policy Coalition (FPC), stated, “We’re thrilled that the Court has ruled in our favor and upheld the Second Amendment, the U.S. Constitution, and Supreme Court precedent. Gov. Grisham’s executive order is blatantly unconstitutional and we look forward to continue proving as much in Court.”
The FPC, along with other gun rights organizations such as the Second Amendment Foundation (SAF), Gun Owners of America (GOA), the National Association for Gun Rights (NAGR), We The Patriots USA, and the New Mexico Shooting Sports Association, supported the lawsuits challenging Governor Lujan Grisham’s order.
Allen M. Gottlieb, founder and executive vice president of SAF, commented on Judge Urias’s order, saying, “We are delighted that the court wasted no time clamping down on Gov. Lujan Grisham’s clearly unconstitutional suspension of Second Amendment rights. No governor has the authority to arbitrarily deny constitutional rights, especially on the flimsy argument this is a public health emergency.”
