“Defendant seeks to have the initial appearance on the Indictment in this matter held via video conference,” U.S. District Judge Christopher Burke wrote in a docket entry Monday, according to the Washington Examiner.
“Government opposes that request,” the entry said.
Judge Burke has given Hunter Biden’s attorneys until Tuesday to present their case for why their client should be allowed to appear virtually, with the prosecution having until Wednesday to respond.
Constitutional attorney Andrew Lieb noted that the request is not entirely unexpected, considering Hunter Biden resides in California.
“The judge is saying, ‘Write papers and I’ll make a decision.’ The judge may say they have to come in,” Lieb told the Examiner.
In addition to the gun charges, Hunter Biden still has unresolved tax issues from 2017 and 2018. A plea deal that would have resolved those charges fell apart in July when it was revealed that it would not prevent future charges.
On Monday, Hunter Biden’s lawyers filed a lawsuit against the Internal Revenue Service (IRS) over the congressional testimony of two whistleblowers who claimed their investigation into Hunter Biden faced obstacles.
The lawsuit argues that the whistleblowers’ status “cannot and does not shield them from their wrongful conduct in making unauthorized public disclosures that are not permitted by the whistleblower process.”
Hunter Biden’s attorney, Abbe Lowell, has called the charges politically motivated, stating that the evidence has not changed but the law and partisan interference have.
“Hunter Biden possessing an unloaded gun for 11 days was not a threat to public safety, but a prosecutor, with all the power imaginable, bending to political pressure presents a grave threat to our system of justice,” Lowell said.
“We believe these charges are barred by the agreement the prosecutors made with Mr. Biden, the recent rulings by several federal courts that this statute is unconstitutional, and the facts that he did not violate that law, and we plan to demonstrate all of that in court,” he added.
