California Foster Parents Required to Affirm Gender Identity of Children in New Law
In a move to support and protect LGBT youth, California Governor Gavin Newsom signed Senate Bill 407 into law on September 23. Introduced by Senator Scott Wiener, the bill amends the foster care vetting process to ensure that foster parents affirm the chosen gender identity and sexual orientation of the children in their care.
Under the new law, potential foster parents must demonstrate their capacity to meet the needs of a child, regardless of their sexual orientation or gender identity. They will also be assessed on their ability to care for and supervise children and youth of all sexual orientations and gender identities.

Governor Newsom expressed his pride in signing this bill, along with other legislation supporting LGBT individuals, stating that California has some of the strongest laws in the nation for protecting and supporting the LGBT community.
Tony Hoang, executive director of Equality California, a non-profit LGBT advocacy group, thanked legislators for their support and criticized opponents of the bill, referring to them as “far-right extremists.”
“We are thankful to our legislative partners for championing these important bills and to Governor Newsom for continuing to be such a strong ally in improving and protecting the wellbeing of the LGBT community as we face growing attacks from far-right extremists,” Hoang said in the same statement.
However, the bill faced opposition from both sides of the political spectrum. Erin Friday, a self-described Democrat and attorney, testified against the bill during a Senate committee hearing, expressing concerns about the potential medical interventions that may follow a social gender transition.
Greg Burt, representing the faith-based advocacy organization California Family Council and the conservative legal defense organization Pacific Justice Institute, argued that the bill would deter religious individuals from becoming foster parents, exacerbating the shortage of foster care homes in the state.
According to Senator Wiener’s office, there are currently 53,371 youth in foster care in California, with approximately 30 percent identifying as LGBT.
