The Heritage Foundation Sues Biden Administration on Behalf of Moms for Liberty
The Heritage Foundation has taken legal action against the Biden administration in support of the embattled parents’ rights group, Moms for Liberty.
“President Biden needs to leave the moms alone,” stated Oversight Project Director Mike Howell in a press release announcing the lawsuit. “But his crooked administration won’t because these parents are the only thing standing between the government and your children.”
The Heritage Foundation’s Oversight Project is demanding records from various federal agencies regarding their communications about Moms for Liberty, which has been labeled an extremist group by the Southern Poverty Law Center.

Heritage has voluntarily requested records under the Freedom of Information Act, but their requests were denied. Now, they are taking the matter to court to obtain records from the departments of Justice, Homeland Security, and Health and Human Services, as well as the FBI. Their goal is to investigate if and how these agencies coordinated with the SPLC concerning Moms for Liberty.
The main concern revolves around the SPLC’s official designation of Moms for Liberty as an extremist group.
“Moms for Liberty is a far-right organization that engages in anti-student inclusion activities and self-identifies as part of the modern parental rights movement,” describes the SPLC. “The group grew out of opposition to public health regulations for COVID-19, opposes LGBTQ+ and racially inclusive school curriculum, and has advocated book bans.”
Heritage suspects that the SPLC may not have acted alone in formulating this description. They believe that SPLC officials, who have made multiple visits to the Biden White House, may have coordinated with federal agencies to launch what they call an “unhinged mob harassment campaign.”
The SPLC’s extremist group label has had tangible consequences for Moms for Liberty.
Organizers had planned an event at the Italian Community Center in Milwaukee, but it was canceled after a reporter from the local Milwaukee Journal Sentinel contacted the center.
The opening sentence of the newspaper’s article about the cancellation reads, “Moms for Liberty, a group designated by the Southern Poverty Law Center as an extremist antigovernment organization…”
Tiffany Justice, co-founder of Moms for Liberty, expressed concern over the SPLC’s actions, stating, “Exercising our free speech rights to attend public school board meetings that decide how our public schools operate is not ‘extremism.’ It is American. Why would the Biden administration not comply with public records requests? What do they have to hide? We look forward to the truth coming to light.”

Moms for Liberty describes itself as a group “dedicated to fighting for the survival of America by unifying, educating, and empowering parents to defend their parental rights at all levels of government.”
The Washington Examiner has reached out to the SPLC, DOJ, DHS, HHS, and FBI for comment.

They maintain that their actions are not an attack on free speech but rather an effort to safeguard the well-being and safety of the American people, especially children.
