New Mexico Judge Upholds Congressional Map Despite Gerrymandering Allegations
In a recent ruling, New Mexico Judge Fred Van Soelen has upheld the state’s congressional map, dismissing claims from Republicans that it was heavily gerrymandered. Despite acknowledging that the map weakened GOP voting power, the judge stated that it did not meet the legal standard of an “egregious” gerrymander.
“Because ‘entrenchment’ is the touchstone of an egregious partisan gerrymander which the New Mexico Constitution prohibits, the court finds that the congressional redistricting map enacted under Senate Bill 1 does not violate the plaintiff’s equal protection rights,” Van Soelen wrote in the order on Friday.
The maps, created by Democrats in the state legislature, have all three congressional districts with a net Democrat partisan voting index, according to the Cook Political Report. This ruling poses a significant challenge for the GOP in their efforts to regain a congressional seat in the state, particularly in the 2nd Congressional District, which is the most favorable for Republicans but still has a Democrat +1 partisan voting index.
Incumbent Republican Rep. Yvette Herrell narrowly lost to Democrat Gabe Vasquez in 2022, making the seat a key target for the GOP in the upcoming 2024 elections as they strive to maintain their narrow majority in the House of Representatives.
The state court’s order can be appealed to the New Mexico Supreme Court, joining other ongoing challenges against congressional maps in states like Alabama and North Carolina.
