Former President Donald Trump’s Ally Steve Bannon Appeals Criminal Conviction
Steve Bannon, a longtime ally of former President Donald Trump, has appealed his criminal conviction for defying a subpoena from the House committee investigating the Jan. 6 incursion at the U.S. Capitol.
Bannon’s attorney argued that he was not ignoring the subpoena, but rather trying to avoid conflicting with executive privilege objections raised by Trump.
“Mr. Bannon acted in the only way he understood from his lawyer that he was permitted to behave,” attorney David Schoen said, emphasizing that Bannon was wrongly prevented from making this argument during the trial.
Prosecutors, however, claimed that Bannon, who was no longer working at the White House at the time, refused to cooperate with the committee in determining if he had any relevant information.
“Stephen Bannon deliberately chose not to comply in any way with a lawful congressional subpoena,” said prosecutor Elizabeth Danello.
The U.S. Court of Appeals for the District of Columbia Circuit is currently reviewing the case.
69-year-old Bannon was convicted of two counts of contempt of Congress last July and was later sentenced to four months in prison. However, U.S. District Judge Carl Nichols put the sentence on hold pending the outcome of the appeal, expressing his expectation that the case would be overturned.
A second Trump aide, trade advisor Peter Navarro, was also convicted of contempt of Congress in September and has also vowed to appeal.
The House panel had sought their testimony regarding Trump’s alleged attempts to overturn the 2020 presidential election.

The Democrat-dominated House Jan. 6 committee released a report in January, alleging that Trump engaged in a “multi-part conspiracy” to overturn the 2020 election results and failed to intervene when his supporters attacked the Capitol.
Bannon is also scheduled to stand trial in May on separate charges of money laundering, fraud, and conspiracy in New York related to the “We Build the Wall” campaign.
He has pleaded not guilty to allegations that he falsely promised donors that their contributions would be used to build a wall along the U.S.-Mexico border, while prosecutors claim the money was actually used to enrich Bannon and others involved in the project.
