“If there is anyone who must have the constitutional right to speak out against the judge, court staff, prosecutor, and process, it is a defendant going through a process he believes has been politicized and weaponized against him.”
Stefanik also argued that Engoron’s gag order amounts to “election interference” since Trump is the front-runner in the GOP presidential primary.
This complaint is in addition to a previous one filed by Stefanik in November, where she accused Engoron of bias against Trump and called for his recusal from the case. Stefanik later filed a supplemental complaint, citing political donations and other conduct by Engoron and his law clerk that she deemed as “illegal” and “biased misconduct.”
Engoron imposed the gag order on Trump in October after the former president criticized the judge’s staff in the civil fraud case. Trump’s lawyers appealed for the gag order to be lifted, but the state’s appeals court rejected their request, stating that no substantial constitutional question was involved.
Stefanik expressed her outrage at the gag order, stating, “Illegally gagging the leading presidential candidate – Democrat Manhattan Judge Arthur Engoron’s election interference - is shocking and appalling. This undermines the public’s faith and confidence in our New York courts.”
The complaint comes amidst Trump’s civil fraud case in New York, where the state Attorney General has accused him and his family business of manipulating financial statements and assets to defraud banks and insurers. Engoron is the presiding judge in the case and will determine the sentencing.
