Biden delays deportation of Palestinians in U.S
President Biden Grants Temporary Protection to Palestinians in the United States
In a move aimed at providing a “temporary safe haven” for Palestinians in the United States, President Joe Biden issued a memorandum on Wednesday. This directive defers the removal of certain Palestinians for a period of 18 months.
According to The New York Post, White House national security adviser Jake Sullivan stated that the order will cover “most Palestinians in the United States.” However, individuals convicted of felonies or considered a public safety threat will not be eligible for this protection. Additionally, those who voluntarily return to the Palestinian territories will lose their eligibility.
Exceptions to the Directive
- Palestinians who have voluntarily returned to the Palestinian territories after Wednesday
- Those who have not continuously resided in the United States since Wednesday
- Individuals inadmissible under section 212(a)(3) of the Immigration and Nationality Act (INA) (8 U.S.C. 1182(a)(3)) or deportable under section 237(a)(4) of the INA (8 U.S.C. 1227(a)(4))
- Individuals convicted of any felony or two or more misdemeanors committed in the United States, or who meet any of the criteria set forth in section 208(b)(2)(A) of the INA (8 U.S.C. 1158(b)(2)(A))
- Individuals subject to extradition
- Those whose presence in the United States is deemed not in the interest of the country or presents a danger to public safety, as determined by the Secretary of Homeland Security
- Those whose presence in the United States would have potentially serious adverse foreign policy consequences for the country, as determined by the Secretary of State
Furthermore, President Biden instructed Secretary of Homeland Security Alejandro Mayorkas to authorize employment for noncitizens whose removal has been deferred. The memorandum also allows for the suspension of regulatory requirements for F-1 nonimmigrant students who are Palestinians, as deemed appropriate by the Secretary of Homeland Security.

Last November, Democrats in the House and Senate sent a letter to President Biden, urging him to authorize Deferred Enforced Departure (DED) for Palestinians in the United States.
Meanwhile, President Biden’s actions have raised concerns about his stance towards Israel. He has criticized Israel’s military operation against Hamas, signed an executive order targeting Israeli civilians, and made questionable statements during a meeting with Jordan’s King Abdullah. These actions have sparked debates about the future of Israel and the rights of Jews to access their holiest place of worship, the Temple Mount.
What are the arguments in favor of President Biden’s decision to grant temporary protection to Palestinians in the United States?
National security or law enforcement
President Biden’s memorandum acknowledges the ongoing conflict in the Palestinian territories and the challenging conditions faced by Palestinians living there. The directive aims to provide temporary relief to Palestinians in the United States who may face hardship or increased risk if they were to be deported back to the Palestinian territories. The decision has received mixed reactions. Proponents argue that it is a necessary step to protect vulnerable Palestinians who are seeking safety and stability in the United States. They believe that this temporary protection will allow these individuals to rebuild their lives and contribute to their communities without fear of deportation. On the other hand, opponents argue that this move is a form of preferential treatment and undermines immigration policies. They argue that the memorandum sets a precedent for granting temporary protection based on nationality, rather than individual circumstances or humanitarian grounds. Critics also express concerns about potential security risks associated with the decision. It is important to note that this directive does not provide a pathway to permanent residency or citizenship for Palestinians. It is a temporary measure aimed at providing relief and protection for a specified period. President Biden’s memorandum emphasizes the need for comprehensive immigration reform to address the broader issues and challenges surrounding immigration policy. In conclusion, President Biden’s decision to grant temporary protection to Palestinians in the United States acknowledges the challenging circumstances faced by Palestinians in the Palestinian territories. The directive aims to provide a temporary safe haven for Palestinians who may face hardship or increased risk if they were to be deported. While the decision has sparked debates and controversy, it highlights the need for comprehensive immigration reform to address the complexities of immigration policy.
