Judge deems July trial date for Jack Smith in Trump classified documents case as “unrealistic
Judge Considers Rescheduling Trial Against Former President Trump
A judge in Florida heard arguments on Friday regarding trial deadlines in the case against former President Donald Trump. Judge Aileen Cannon, who initially set the trial to begin on May 20, expressed doubts about the proposed trial start date of July 8, calling it “unrealistic.”
During the hearing in Fort Pierce, Florida, Cannon did not make a final decision on a new date. However, it is expected that the trial will be rescheduled, as the judge had previously extended pretrial deadlines, making the original May date logistically impossible.
Trump’s attorneys argued that the trial should not take place until after the 2024 election, emphasizing his rights under the Constitution. They stated that as the leading candidate in the 2024 election, Trump should be able to participate fully in the proceedings and engage in campaign speech.
Special counsel Jack Smith, who is handling both this case and a criminal case against Trump in Washington, D.C., has been pushing for an expedited process. He suggested that the trial could take place in September or October, even during the final stretch of Trump’s presidential campaign.
Smith also argued that a Department of Justice policy limiting politically sensitive investigations and prosecutions in the 60 days leading up to an election does not apply once a prosecution has already begun.
Last year, Smith indicted Trump and two co-defendants on charges of conspiring to retain national defense information at Trump’s Mar-a-Lago residence in Florida and obstructing the investigation. Trump, along with his aide Walt Nauta and Mar-a-Lago employee Carlos de Oliveira, have pleaded not guilty to the charges.
