Former presidential candidate Vivek Ramaswamy applied an “airtight” test Monday to prove the existence of the politicized prosecution facing former President Donald Trump in his hush money trial.

“All we’ve seen is one more layer of the onion of how the whole thing is a charade,” Ramaswamy told entrepreneur Patrick Bet-David on an episode of the PBD Podcast.

Ramaswamy then gave the crew of the PBD Podcast a “good litmus test” to determine whether or not someone is on the wrong end of politicized prosecution.

“If the prosecution’s theory of the case said you did something wrong, what if you had done the exact opposite thing?” he said. “That should mean you did not do something wrong.”

When it comes to the hush money trial against Trump, the prosecution argues that Trump’s payment to adult film star Stormy Daniels should have been recorded as a campaign contribution, according to Ramaswamy.

“That’s the heart of the case,” he said. “Without that, they couldn’t charge this as a felony. It would only be a misdemeanor that’s outlived the statutes of limitations.

“It’s a misdemeanor, not a felony,” he continued. “The only basis for this being a felony is if there’s a different underlying crime, which what they allege is that he made effectively a campaign contribution without it being recorded as such.”

Ramaswamy returned Bet-David and the crew to his litmus test.

“Imagine you did the exact opposite,” he said. “What would the exact opposite be?

“The exact opposite would be Donald Trump using campaign funds to make a personal hush money payment. In that scenario, I have no doubt these people would be going after him, and they would have a much stronger case in that scenario.”

Even if Trump did the “exact opposite” thing of what he is accused of, he would still be charged because his opponents want to get him no matter what, according to Ramaswamy.

“I think everybody kind of knows it in their bones, but you’ve got to just see it,” Ramaswamy said. “Damned if you do. Damned if you don’t. Literally, they were going to get him going or get him coming, and that, I think, is the airtight proof that this thing is a sham.”
