Trump seeks Supreme Court to stop sentencing in hush money case
President-elect Donald Trump filed an urgent appeal on Wednesday with the Supreme Court to postpone his sentencing in a criminal case involving hush money payments.
The sentencing, set for Friday, stems from 34 counts of falsifying business records related to a payment made during the 2016 presidential campaign.
“President Trump’s legal team filed an emergency petition with the United States Supreme Court, asking the Court to correct the unjust actions by New York courts and stop the unlawful sentencing in the Manhattan D.A.’s Witch Hunt,” Trump spokesman and incoming White House communications director Steven Cheung said.
Trump’s legal team argues that proceeding with sentencing at this time would disrupt his presidential transition and preparations for his Jan. 20 inauguration. His team also questioned the validity of the guilty verdict in its filing.
The request comes as Trump has been blocked at every juncture from delaying his latest sentencing date, which has been postponed several times since it was initially scheduled in July.
Meanwhile, New York State Supreme Court Justice Juan Merchan, who presided over the trial, said last week that Trump would be unconditionally discharged, a term meaning he will not face jail time or probation as part of the sentencing.
In their appeal, Trump’s attorneys emphasized that, as president-elect, he should be immune from criminal proceedings, asserting that delaying the sentencing is necessary to avoid significant harm to the presidency and the federal government’s operations.

“Forcing President Trump to prepare for a criminal sentencing in a felony case while he is preparing to lead the free world as President of the United States in less than two weeks imposes an intolerable, unconstitutional burden on him that undermines these vital national interests,” Trump’s attorneys wrote in their emergency petition.
The Supreme Court has requested a response from New York state prosecutors by Thursday morning.
