FACT CHECK: Did Dominion Voting Systems Lose Its Lawsuits Against Rudy Giuliani And Sidney Powell?
A post shared on Facebook over 800 times claims Dominion Voting Systems lost its lawsuits against former New York Mayor Rudy Giuliani and lawyer Sidney Powell.

Court records show Dominion Voting Systems’ respective lawsuits against Powell and Giuliani are still active as of press time.
Fact Check:
Dominion Voting Systems sued Giuliani and Powell for defamation in January 2021 over false claims made about the company and its role in the 2020 election, according to Business Insider. In recent days, some social media users have been sharing the claim that the election technology firm lost its respective lawsuits against Giuliani and Powell.
There is no indication on Public Access to Court Electronic Records (PACER) at this time that the election technology firm has lost the two lawsuits. Check Your Fact also looked at CourtListener, a website from the Free Law Project that has a “fully-searchable and accessible archive of court data,” and found that neither lawsuit has been dismissed. Both cases are still active at the time of publication, according to court records accessible via PACER and CourtListener.
Giuliani filed a motion to dismiss the case against him April 7, and on May 24, his lawyers filed a “reply to opposition to motion” to support his motion to dismiss the case. This does not mean the case has actually been dismissed. Dominion Voting Systems’ lawyers have not yet responded to the motion, records from PACER and accessed by CourtListener show.
In a similar move, Powell’s lawyers also filed a “reply to opposition to motion” to support her asking the court to dismiss the firm’s lawsuit against her May 24. Dominion Voting Systems’ website has a page with updates on the legal actions the company has taken in the aftermath of the 2020 election, including the lawsuits against Giuliani and Powell. There is no mention on that page of either lawsuit reaching a conclusion as of press time.
The election technology company hired public relations firm Hamilton Place Strategies after the November election, according to The Daily Beast. Alexa Green, a spokesperson for Hamilton Place Strategies, told Check Your Fact in an email that the “defamation suits against Sidney Powell and Rudy Giuliani are still active.”
