The Food and Drug Administration is expected to ask for more time to consider if e-cigarette maker Juul can keep its products on shelves. Reports said the administration has until Thursday to review applications for around 6.5 million products from more than 500 different companies in order to determine if their products are in the interest of public health.

“The FDA’s opaque review process was intentionally designed to eliminate all but the largest players from the market,” said American Vaping Association President Gregory Conley. “We look forward to lending our support to future court challenges.”

Manufacturers were asked to submit evidence showing their products were less harmful than cigarettes and that they helped smokers stop smoking. The FDA has already denied around 55,000 applications from smaller manufacturers, mostly centered around flavored vape products, which have been the focus of much of the public’s concern.

“There’s more work to be done to complete our remaining reviews and ensure that we continue taking appropriate action to protect our nation’s youth from the dangers of all tobacco products, including e-cigarettes,” said the FDA in a statement. The review comes following a major surge in youth smokers across the U.S.
