Texas can keep floating Rio Grande barriers, appeals court rules.
Texas Wins Temporary Stay to Keep Floating Buoy Barriers in Rio Grande
Texas has been granted a temporary stay by a U.S. appeals court, allowing the state to maintain its floating buoy barriers in the Rio Grande. This decision comes after a federal judge ordered Texas to remove the barriers and halt any further construction to prevent immigrants from crossing the border. The judge’s order was scheduled to take effect on September 15.

On Thursday, the appeals court’s ruling provided relief for Texas, potentially delaying the need to relocate the buoys to the river bank immediately. Governor Greg Abbott of Texas, a Republican, expressed his intention to appeal the decision and even take the legal battle to the Supreme Court if necessary.
The floating barriers are just one of the strategies employed by Governor Abbott to deter immigrants from entering the state through the southern border. Another tactic includes the placement of coils of razor wire along the river.
The use of floating barriers gained national attention in July when a state trooper reported the detrimental consequences of Texas’ border security efforts on immigrants. The complaint alleged that immigrants had suffered injuries and even lost their lives due to the state’s increasingly hostile barbed wire and water buoy barriers at the border.
One disturbing allegation claimed that Texas authorities were instructing troopers to push migrant children back into the river and deny water to migrants during extreme heat.
