A Federal Judge Orders Status Report on Felony Gun Charge Against Hunter Biden
A federal judge in Delaware has taken action in the ongoing case involving Hunter Biden, son of President Joe Biden. Judge Maryellen Noreika has ordered both prosecutors and defense attorneys to provide a status report on the felony gun charge against Hunter Biden by next Wednesday.
The judge wants the report to include any necessary steps that the court needs to take regarding the case. This development comes after attorneys for Biden argued that a “diversion agreement” is still in effect, which would spare him from prosecution on the gun charge. However, prosecutors claim that the agreement is no longer valid.
The two-part deal, which involved tax and gun charges, was meant to resolve a long-running investigation overseen by Delaware U.S. Attorney David Weiss. However, the deal fell apart when Judge Noreika raised concerns about its terms during a hearing in July.
Prosecutors were unable to address the judge’s concerns about granting immunity for certain crimes in the diversion agreement instead of the plea deal. The judge expressed her refusal to simply “rubber stamp” the deal, as she had concerns about its atypical provisions.
Before the hearing, Republicans criticized Biden’s plea agreement as a “sweetheart deal.” The agreement involved Biden pleading guilty to failing to pay taxes on over $1.5 million in income. Prosecutors revealed that his income during those years included substantial amounts from business and consulting fees with Chinese and Ukrainian companies.
The diversion agreement aimed to spare Biden from prosecution on the felony gun charge if he stayed out of trouble for two years. However, with the collapse of the plea deal, Attorney General Merrick Garland appointed Weiss as a special counsel with broad investigative powers.
As the case continues to unfold, the judge’s order for a status report indicates that there are still unresolved issues surrounding the felony gun charge against Hunter Biden.
