Biden picks 2 GOP nominees for FTC roles.

President Joe Biden has exciting news! He plans to nominate Virginia Solicitor General Andrew Ferguson and Utah Solicitor General Melissa Holyoak as Republican commissioners of the Federal Trade Commission (FTC).

The White House made the announcement on July 3, following a longstanding practice of including bipartisan membership. This move aims to ensure fair representation and diverse perspectives within the FTC.

Before they can start working for the agency, Biden’s nominees need confirmation from Senate lawmakers. The FTC, consisting of five commissioners, plays a crucial role in protecting U.S. consumers from fraudulent behavior, deceptive advertising, and unfair business practices.

If confirmed, the FTC will have a Democratic chair, Lina Khan, along with two Republican and two Democratic commissioners. This composition maintains a balanced power dynamic within the agency.

Andrew Ferguson, currently serving as Virginia solicitor general, brings a wealth of experience to the table. He previously worked as chief counsel to Senate Republican Leader Mitch McConnell and held key positions in the Judiciary Committee under Lindsey Graham and Chuck Grassley.

Ferguson’s legal career also includes working at prestigious law firms in Washington, D.C., and clerking for Judge Karen L. Henderson and Justice Clarence Thomas.

Melissa Holyoak, described as an “experienced litigator,” has dedicated much of her 20-year practice to consumer protection. Before joining the Utah Attorney General’s Office, she served as president and general counsel of Hamilton Lincoln Law Institute, a public interest firm in Washington, D.C.

Holyoak’s previous work with organizations like the Competitive Enterprise Institute and the Center for Class Action Fairness showcases her commitment to advocating for consumer rights.

Nominees Welcomed by FTC Chair

FTC Chair Lina Khan, who was nominated by President Biden in 2021, expressed her support for the Republican nominees. In a statement, she said, “I congratulate Andrew Ferguson and Melissa Holyoak on their nominations to serve on the Federal Trade Commission. Each would bring key skills, experiences, and expertise to the Commission as we work to promote fair competition and protect Americans from unfair or deceptive practices.”

Khan emphasized the importance of a fully staffed Commission and looks forward to collaborating with Ferguson and Holyoak to fulfill the vital mandate given by Congress.
