Cruz stated that Sohn needed to be confirmed a year after her first appearance in 2021 because she hadn’t disclosed the agreement to Senate Commerce Committee prior to her initial appearance.
After a hearing held in February 2022 the committee was divided 14-14 over her nomination. Despite her nomination being advanced to the full Senate without a vote, it was confirmed by Democrats.
