Nonprofits Sue Washington State Attorney General for Targeting Pro-Life Pregnancy Centers
Two nonprofits that operate crisis pregnancy centers have filed a lawsuit against Washington state Attorney General Robert Ferguson, accusing him of unlawfully and unconstitutionally singling them out because of their pro-life beliefs.
The complaint, filed on Nov. 29 in federal court, alleges that Ferguson is making unreasonable demands on the Christian nonprofits Obria Group and My Choices, requiring them to disclose privileged or irrelevant materials for an investigation that lacks a complaint or reason to suspect unlawful activity.
Ferguson’s probe aims to determine if the nonprofits violated Washington’s Consumer Protection Act.
The lawsuit claims that the attorney general has demanded answers and documents related to patient data and statements about Abortion Pill Reversal, a service the nonprofits do not provide or profit from. The suit argues that Ferguson is specifically targeting Obria Group for advertising this legal medical procedure.

The lawsuit argues that Ferguson’s office has launched an exploratory probe into the lawful activities, constitutionally protected speech, religious observance, associations, and nonpublic communications of the nonprofits, solely because of their differing views on a matter of public policy.
In May 2022, Ferguson issued a broad demand for patient information dating back to 2010. Obria provided over 1,500 pages of documentation in response, but when Ferguson made further demands, the Alliance Defending Freedom (ADF) sued him to stop the alleged harassment.
The nonprofits are seeking an injunction to prevent the enforcement of Ferguson’s demands, allowing them to freely express their beliefs, exercise their faith, and continue providing services to women and men facing difficult pregnancy circumstances.
ADF Senior Counsel Tim Garrison stated, “Our clients have already expended exorbitant time and financial resources trying to comply with the unreasonable demands made by Washington’s attorney general, and we urge the court to swiftly halt his unlawful actions.”
The lawsuit argues that the investigative demands violate the nonprofits’ rights protected by the First, Fourth, and 14th Amendments of the U.S. Constitution.
ADF contends that pro-life pregnancy centers should not be treated differently than abortion providers like Planned Parenthood.
During an August 2019 press conference, Ferguson stated that his office had worked closely with Planned Parenthood in litigation related to abortion. ADF also highlighted instances where Ferguson hosted a press conference and agreed with false statements made about pregnancy centers by the Washington state director of Planned Parenthood Alliance Advocates.
Obria Group and My Choices offer various services, including pregnancy testing, counseling, STD/STI testing, ultrasounds, prenatal care, and well-woman examinations, under the direction of a licensed physician.
Ferguson, who is running for governor of Washington, has made abortion advocacy a primary feature of his campaign.
