Bragg asks judge to keep Trump hush money case intact – Washington Examiner

Manhattan District Attorney alvin Bragg has requested ‍a judge ‍to dismiss President-elect Donald Trump’s motion to annul his hush money conviction. This legal action is part of ongoing proceedings regarding the hush money payments made during the election campaign. ⁢Bragg’s appeal highlights the judicial efforts to maintain the integrity of the case amidst Trump’s attempts to ‌have the‌ charges overturned.


Bragg asks judge to keep Trump hush money case intact

Manhattan District Attorney Alvin Bragg asked a judge to reject President-elect Donald Trump’s request for his hush money conviction be tossed out, according to a court filing made public on Tuesday.

Prosecutors for Bragg wrote in the lengthy filing that they opposed Trump’s request, that the verdict in the case should stand, and that Trump should be sentenced after a jury found him guilty this year of falsifying business records.

“The extreme remedy of dismissing the indictment and vacating the jury verdict is not warranted in light of multiple alternative accommodations that would fully address the concerns raised by presidential immunity,” prosecutors wrote.

Trump’s attorneys argued earlier this month that as president-elect, Trump was exempt from participating in any court proceedings because he had presidential immunity and other constitutional protections.

“Wrongly continuing proceedings in this failed lawfare case disrupts President Trump’s transition efforts,” Trump’s attorneys had said.

Judge Juan Merchan postponed Trump’s sentencing indefinitely last month to give Trump and Bragg time to make arguments for and against dropping the case entirely.

Manhattan prosecutors said that at most, Trump’s sentencing hearing and any appellate proceedings could be postponed until after Trump leaves office in four years.

Dismissal would “subvert the compelling public interest in preserving the jury’s unanimous verdict and upholding the rule of law,” prosecutors wrote.

Trump’s attorneys had also argued that, in light of President Joe Biden pardoning his son Hunter and justifying it by saying the Biden Department of Justice treated the first son unfairly, the Manhattan court should extend Trump similar treatment. Trump’s attorneys reasoned that the same DOJ, which Biden argued was politicized, “sent” former DOJ official Matthew Colangelo to work in Bragg’s office and prosecute Trump.

Despite Trump’s attorneys claims, no evidence exists that the DOJ coordinated with Bragg to bring charges against Trump.

 

Trump was convicted in May on 34 counts of falsifying records related to a payment made to porn star Stormy Daniels ahead of the 2016 election. The charge carries a maximum term of four years in prison, but guidelines suggest Trump would receive a far lower penalty than that if the sentencing were to move forward.

Legal experts have said that while Trump is preparing to take office or in office, he cannot face any jail time or probation because it would interfere with his presidency.
